1. Acceptance of Terms

By accessing or using YzeTrade's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These terms constitute a legally binding agreement between you and YzeTrade Ltd. ("YzeTrade," "we," "us," or "our"). Your use of our platform indicates your acceptance of these terms and creates a contractual relationship.

2. Service Description

Platform Overview

YzeTrade provides an automated cryptocurrency trading platform that:

  • • Connects to your cryptocurrency exchange accounts via API
  • • Executes trades based on TradingView alerts and custom strategies
  • • Provides portfolio management and performance analytics
  • • Offers risk management tools and position sizing controls

Service Limitations

Our services are subject to the following limitations:

  • • We do not provide investment advice or financial planning services
  • • We do not guarantee trading profits or protect against losses
  • • Service availability may be interrupted for maintenance or technical issues
  • • Platform performance depends on third-party services and market conditions

3. User Eligibility and Account Requirements

Eligibility Criteria

To use our services, you must:

  • • Have the legal capacity to enter into contracts

5. Fees and Payment Terms

Service Fees

You may not:

  • • Attempt to reverse engineer, hack, or circumvent our security measures
  • • Share your account access with unauthorized third parties
  • • Use our platform to manipulate markets or engage in fraudulent trading
  • • Provide false or misleading information during registration or verification

API Usage

When connecting exchange APIs, you must ensure that API keys have appropriate permissions (trading only, no withdrawals) and maintain the security of your exchange accounts.

7. Platform Availability and Performance

Service Level

We strive to maintain high platform availability but cannot guarantee uninterrupted service. Our target uptime is 99.9%, but actual availability may vary due to:

  • • Scheduled maintenance and updates
  • • Emergency security patches
  • • Third-party service outages
  • • Network connectivity issues

No Performance Guarantees

We do not guarantee the performance, profitability, or accuracy of trading strategies. Past performance does not indicate future results, and all trading involves risk of loss.

8. Intellectual Property

YzeTrade and its licensors own all intellectual property rights in the platform, including software, algorithms, designs, and content. You receive a limited, non-exclusive license to use our services for their intended purpose.

You retain ownership of your trading strategies, configurations, and data. However, you grant us a limited license to process this information to provide our services.

9. Limitation of Liability

To the maximum extent permitted by law, YzeTrade shall not be liable for:

  • • Trading losses or missed opportunities
  • • Platform downtime or technical failures
  • • Third-party service interruptions
  • • Data loss or security breaches beyond our control
  • • Indirect, consequential, or punitive damages

Our total liability to you shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless YzeTrade from any claims, losses, or damages arising from your use of our services, violation of these terms, or infringement of third-party rights.

11. Termination

Termination by You

You may terminate your account at any time by following the cancellation process in your account settings. All active trading will be stopped, and you remain responsible for any outstanding fees.

Termination by Us

We may suspend or terminate your account if you:

  • • Violate these terms or applicable laws
  • • Fail to pay required fees
  • • Engage in prohibited activities
  • • Provide false information

Effect of Termination

Upon termination, your access to the platform will cease, all trading will stop, and you must disconnect any API connections. Data retention will follow our Privacy Policy.

12. Dispute Resolution

Binding Arbitration

Most disputes will be resolved through binding arbitration rather than court proceedings. Arbitration is conducted under the rules of the Canadian Arbitration Association.

Exceptions

The following disputes are not subject to arbitration:

  • • Intellectual property disputes
  • • Requests for injunctive relief
  • • Small claims court proceedings

13. Governing Law

These terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles. Any legal proceedings must be brought in the courts of Toronto, Ontario.

We may modify these terms at any time by posting updated terms on our website. Material changes will be communicated via email with at least 30 days notice. Continued use after changes become effective constitutes acceptance.
